GENERAL TERMS AND CONDITIONS

ORDERS

Orders are binding as soon as TIMECH BV receives them.

DELIVERY

The risk of the delivered goods passes to the buyer as soon as he takes delivery of them.

WARRANTY

A warranty is given on the parts according to factory conditions.

REPOSSESSION / EXCHANGE / RETURN

Goods will only be returned after consultation with TIMECH BV.

A minimum price of 15% of the amount charged will be charged when the goods are returned.

PAYMENTS

All invoices are payable within 30 days of the invoice date, unless otherwise agreed.

In case of non-payment within this period, interest at 10% will be due from the invoice date.

In the event of non-compliance with the contractual obligations by one of the parties, they will have to pay compensation of 15% of the invoice amount with a minimum of € 40.00.

For all disputes relating to the present agreement and invoice, only those courts designated in accordance with art. 624 of the Judicial Code shall be competent.

Complaints will only be accepted if they are made known within 5 days.

Timech B.V. – hereinafter referred to as "company" – wishes to inform you about the way in which your personal data is collected, processed and protected:

1. Purpose and procedure for data processing

The personal data ("data") provided by you will be processed for the following purposes:

  • the execution of sales contracts and/or service contracts in order to fulfil the Company's contractual obligations;

  • communicating data to CNH Industrial Belgium and their related subsidiaries and the affiliates of the CNH Industrial Group, in order to allow them to fulfil their obligations in relation to the warranty and safety of the product; provide assistance services, including through the network of approved workshops; responding to and fulfilling customer requests; sending communication of a technical and/or organisational nature; conducting surveys to improve the quality of the goods and/or services supplied, on the basis of the legitimate interest of the manufacturer;
  • enable the Company to conduct customer satisfaction surveys ("Customer Satisfaction") regarding the quality of the goods and services in accordance with the Company's legitimate interest;
  • subject to your express consent, sending commercial communications and advertising about the Company's products and services, or conducting market research ("Marketing");
  • subject to your express consent, communicating data to CNH Industrial Belgium and to their affiliated subsidiaries and CNH Industrial group affiliates for the purpose of sending commercial communications and advertising about their products and services, or to conduct market research ("Third Party Marketing").

The data is collected and processed on the basis of the contract and the company's explicit and legitimate interest in processing it in accordance with points (a), (b) and (c) and subject to your explicit consent to the marketing described under (e) and (f). Please note that you can revoke your consent at any time.

The data may be processed on paper, by automated or electronic means, including by post or e-mail, telephone (e.g. automated telephone calls, SMS, MMS), fax and any other means (e.g. websites, mobile apps).

2. Consequences of not providing data

You are never obliged to provide any data. However, failure to provide the data necessary for a sale or to provide a service or product and which is indicated as mandatory may prevent us from offering the required service or product or may lead to a sub-optimal delivery of the required services or products. Failure to provide data whose provision is marked as optional will in any event enable you to use the service or receive the product.

3. Recipient of the data

In the course of our activities, data may be shared and communicated to CNH Industrial Belgium and CNH Industrial Group's subsidiaries and affiliates, authorized workshops, service providers, located in and outside the European Union, who have a specific contractual obligation and may only use it for the purposes mentioned above.

The data may be transmitted to third parties in order to comply with legal obligations, to comply with decisions of public authorities or to exercise a right of the company before the judicial authorities.

4. Data transfer outside the EEA

Within its contractual relationships, the Company may transfer the data to countries outside the European Economic Area (EEA), including the storage of data in databases managed by entities acting on behalf of the Company. Database management and data processing are limited to the purposes of the processing and are carried out in accordance with applicable data protection laws.

In the event of a transfer of the data outside the EEA, the Company will take all appropriate contractual measures to ensure adequate protection of the data, including – among other things – agreements based on the standard contractual clauses approved by the EU Commission on the transfer of personal data outside the EEA.

5. Data Controller and Data Protection Officer

6. Data Retention

The Company will retain the data in its systems and archives for as long as necessary to achieve the purposes described in this Privacy Notice, taking into account, where applicable, legal and contractual requirements. If necessary to protect its interests with regard to possible liability in connection with the provision of the services or products, the Company may continue to store the data for a longer period of time.

Data processed for marketing and profiling purposes will be kept until you withdraw your consent and in any case in accordance with the above-mentioned principle and the guidelines of the relevant privacy authorities in this regard.

7. Your rights

You can exercise the following rights:

  • Right of access: the right to be informed by the Company whether your data is being processed and, if applicable, to have access to the data;
  • Right to rectification and right to erasure means the right to obtain the rectification of inaccurate and/or incomplete data, and to erase the data when the request is legitimate;
  • Right to restriction of processing means the right to request the suspension of processing where the request is legitimate;
  • the right to data portability is the right to obtain the data in a commonly structured and readable format, as well as the right to transfer data to another controller;
  • Right to object is the right to object to the processing of data where the request is legitimate, including where the data is processed for marketing or profiling, where applicable;
  • the right to lodge a complaint with a supervisory authority in the event of unlawful processing of data.
